June 8, 2012 A 37-year-old man arrested in Menasha for driving drunk is taking his case the state Supreme Court.
Justices on the high court are going to hear the case of Juan Garcia, and his arguments that two of his convictions should be dismissed.
He was arrested in February of 2010, after police say he hit a yellow traffic light pole and left a license plate at the scene. Garcia argues that when police tracked him to his trailer home, they arrested him after coming in without a warrant.
Police say he wouldn't open the door when they found his damaged car outside, but Garcia's brother came home and let them in. They say Garcia's bedroom door was locked, but his brother forced it open, to make sure Garcia wasn't hurt.
Police then arrested him, for his fourth OWI.
Garcia is also appealing the 1998 conviction for his second offense, arguing he didn't know that a lawyer could've come up with a possible defense.
The state court of appeals ruled against Garcia. |
