MADISON, Wis–The state court of appeals upholds the city of Neenah’s authority to build a walking trail along Lakeshore Avenue. A group of homeowners along the street sued to have the trail removed from the reconstruction plan two years ago.
A Winnebago County judge initially ruled in favor of the city, and that was upheld by the appeals court this week. Had the lawsuit gone in favor of the homeowners, the city could have been required to tear up the trail.
The homeowners have not decided if they will appeal to the state Supreme Court.
