APPLETON, Wis. — Appleton Police believe the fatal shooting of a home invasion suspect was justified.
Detectives will not recommend charges against the resident of a home in the 2800 block of E. Newberry Street that shot and killed Jonathan Tolley, 38, in June of last year.
An investigation determined Tolley, forcibly entered the home, damaged items inside, started yelling at the residents in a bedroom, and ignored orders to stop moving toward them.
Tolley was shot once. Investigators found no connection between Tolley and the homeowners.
His blood alcohol level at the time was more than three-times the legal limit to drive.
